UK Budget promises targeted visa changes, but applicants must follow current rules

Planned salary reforms and a selective two-year Graduate route could help some applicants, but implementation dates and eligibility details remain separate from the announcement.

A graduate choosing a UK course cannot yet assume the Budget has restored two years of post-study permission for everyone. The UK Budget visa package promises that period for graduates of qualifying universities, while the published rules still set an 18-month ordinary Graduate route for applications from 1 January 2027.

The 28 October 2026 Budget also promises changes to skilled-worker salaries, the High Potential Individual route and the time some sponsored workers could have to find another job. The measures affect different people, use different tests and do not all start together.

For Indian students and professionals, the immediate task is to separate an announced opportunity from an application that can lawfully be made now. A university offer, a salary negotiation or an overseas degree assessment should be checked against the rules for the relevant route and date.

What does the UK Budget visa package actually announce?

It sets out targeted changes to graduate and skilled migration, with key salary reforms planned for spring 2027.

The Treasury’s Budget document proposes occupation-specific salary thresholds at the 25th percentile, an uprated general threshold, annual wage-based updates, a single new-entrant discount and removal of the PhD discount. It also announces an HPI expansion to the top 150 global institutions, a proportionate cap increase, two-year Graduate permission for eligible universities and up to six months’ curtailment for certain highly skilled workers.

These commitments establish the policy direction. They do not supply every new salary amount, a complete list of universities qualifying for the Graduate exception or the individual conditions for the longer curtailment period. Those details matter before anyone can rely on the benefit.

The practical effect could also differ between applicants. Lowering an occupation’s going rate may help one employer recruit. It may do little for another job if the separate general salary floor remains the higher requirement.

Which salary test applies to a Skilled Worker application now?

The ordinary current test is the higher of £41,700 a year and the occupation’s applicable going rate, subject to route-specific exceptions.

The Home Office’s job and salary guidance also requires an eligible job and an approved employer. The occupation code matters because it determines the relevant work category and rate. A job title alone is not a sufficient salary check.

The Budget’s proposed move to the 25th percentile concerns occupation-specific requirements. It should not be read as permission for every employer to offer a salary at that level immediately. Nor does a fall in one component necessarily mean the final qualifying salary will fall by the same amount.

For a recruitment discussion taking place now, ask the employer to identify the occupation code, the applicable going rate, the general threshold and any exception being relied upon. Keep the answer with the proposed hours and pay. A claim that sponsorship has become easier is not a substitute for that calculation.

What is an occupation’s going rate? It is the salary benchmark attached to the relevant occupation code in the immigration rules. It operates alongside the general salary threshold. Where the usual test applies, meeting the lower of those two figures is insufficient.

Can new entrants or PhD holders still use current salary provisions?

Current concessions remain governed by the published rules until the relevant changes take effect.

The guidance on when a Skilled Worker can be paid less distinguishes several categories. It also explains that time already spent on the Graduate route can count towards the four-year limit relevant to certain new-entrant concessions. Eligibility is more specific than simply being young or holding a recent degree.

The announcement that the PhD discount will be removed concerns a future change. A candidate should not assume that a concession has already disappeared, or that it will remain available indefinitely, without checking the rules applying to the proposed application.

For someone moving from study to employment, the useful comparison is between the actual application options and their dates. Waiting for a promised change can affect the time left on existing permission. Applying under a concession requires evidence that the current conditions are met, rather than an expectation that later policy will be more generous.

Has the two-year Graduate visa been restored for every university?

No. The Budget promise is selective, while the current published application-date rule remains in place.

The Graduate visa overview says eligible non-doctoral applicants receive two years if they apply by 31 December 2026, and 18 months if they apply from 1 January 2027. Doctoral graduates receive three years. The application must be made in the UK after the education provider has notified the Home Office of successful course completion and before the relevant student permission expires.

The Graduate appendix to the Immigration Rules sets out the periods formally. That is the document against which a new exception needs to be checked when it is implemented.

A student cannot establish eligibility for the promised two-year exception simply because a university is well known, highly ranked or says its graduates find jobs. The government’s high-compliance and labour-market conditions need their own published definitions and implementation arrangements.

How is the HPI route different from the Graduate route?

HPI is based on an eligible overseas university qualification, whereas the Graduate route follows qualifying UK study.

The HPI eligibility guide requires applicants to check the university list for the month and year their qualification was awarded. A qualification must have been awarded within the last five years and assessed at the appropriate level. UK universities are not eligible for HPI.

The HPI appendix currently caps the route at 8,000 applications in an allocation year running from 1 November to 31 October. The Budget’s expansion should not be converted into a specific new numerical cap before the government publishes it.

The distinction is important for an Indian national who studied outside Britain. Nationality alone does not establish HPI eligibility, and a university’s appearance in a current ranking is not the same as its inclusion on the appropriate government list. The relevant evidence is the award, the institution and the applicable list.

Does an HPI visa offer permanent residence?

No. HPI is temporary permission and is not itself a route to settlement.

The HPI overview describes two years’ permission, or three years for a doctoral qualification. It cannot be extended, although a person may qualify to switch into another route. Its unsponsored nature makes it different from starting with an employer-sponsored work visa.

That flexibility can help a graduate look for work, but it is not a job guarantee. A family comparing options should ask two separate questions: whether the applicant qualifies for HPI now and what would be required to remain after it expires. A plan which answers only the first leaves the later decision unresolved.

The existing study-abroad comparison provides broader context for course decisions. The UK student-visa report explains a different part of the system: obtaining student permission and the requirements affecting institutions.

Should sponsored workers assume they now have six months after losing a job?

No. The promised longer curtailment period is not a universal extension for every sponsored worker.

The Treasury describes a measure for the highest-skilled workers, with duration linked to time spent in a previous highly paid job and implementation in 2027. A worker should therefore not replace a deadline in an actual Home Office notice with six months calculated from a news report.

A job ending, sponsorship being withdrawn and permission being curtailed are related events, but the individual circumstances and official decision remain important. Anyone facing an immediate deadline should use that decision and regulated advice, rather than wait for a policy whose full conditions have not yet been issued.

What should applicants ask before relying on a promised benefit?

Ask which rule creates the benefit, who qualifies, when it starts and whether transitional arrangements cover the intended application.

For students, the missing detail may be the university criteria and the relevant application date. For employers, it may be the new general salary floor or treatment of an occupation. For HPI applicants, it may be the revised list and cap. These are different questions; one announcement does not resolve them all.

Before paying for a course or accepting a role, keep a written record of the assumptions being used. If a university or recruiter describes a future policy as certain, ask for the official rule and commencement provision supporting that statement. That makes the decision easier to revisit if the final implementation differs.

How should readers use this guidance?

Use the Budget to identify changes worth following, then use current Home Office rules for an application.

The position was checked on 1 November 2026. The next step is publication of the detailed rules and guidance implementing the promised measures. Until then, a qualified UK immigration adviser can assess an individual case against the framework actually in force, including any approaching expiry or application deadline.
