Oman sets January start for recruitment-agency insurance, deadlines and refund rules

The regulation distinguishes employer refunds from worker protections, requiring licensed offices to use written offers while Indian recruits still need the appropriate employment clearances.

A recruitment office bringing a worker to Oman will face a 45-day delivery period under a regulation taking effect on 1 January 2027. The Oman recruitment rules also require insurance for service contracts and define when an employer can seek a refund or agree to a replacement worker.

The framework is Ministerial Decision 390/2026, issued in October, rather than a rule first created this week. A recent Ministry of Labour workshop has brought its financial and contractual requirements back into focus ahead of commencement.

For an Indian worker, the distinction between those requirements matters. Insurance of a recruitment service is not automatically personal health cover, a guarantee that wages will be paid or a new right to work. An employer’s refund claim against an office is also different from a worker’s claim against an employer.

When do the Oman recruitment rules take effect?

They take effect on 1 January 2027 and replace the 2011 regulation governing the recruitment of non-Omani manpower. Existing licences continue until expiry, with renewal subject to the new framework.

The regulation’s published Arabic text identifies the Ministry of Labour as the competent authority and requires a licence to carry out the activity. The General Federation of Oman Workers also makes the ministerial decision available through its legislation material.

The framework covers recruitment offices and their relationships with employers and recruited workers. Its commencement should not be confused with the issue date of a worker’s own permit or the starting date in an employment contract.

For arrangements spanning the change, ask the ministry or a qualified adviser how the regulation applies to the actual licence and contract. A general report cannot determine every transition merely from the month a worker intends to travel.

What are the five checks for a recruitment arrangement?

Check the office’s licence, the written job offer, the service-contract timetable, the insurance wording and the refund conditions. Each establishes a different responsibility.

Item Requirement or distinction to check
Licensed office Ministry of Labour authorisation for the recruitment activity
Worker’s written offer Job, duties, conditions and wages communicated before arrival
Recruitment timetable Up to 45 days from the service contract, unless a shorter period is agreed
Insurance Policy attached to the service contract, including covered events and starting dates
Guarantee and remedy Applicable period, qualifying event, notification and refund or replacement terms

The normal recruitment period can be extended by written agreement for up to 30 additional days if the office fails to meet the deadline. Otherwise, the employer can terminate under the conditions of the regulation. An informal promise to “wait a little longer” should not be treated as the written agreement specified in the text.

The 45-day period is not a promise that every work-permit decision or every Indian emigration process will take that long. It concerns the office’s service-contract obligation. The worker’s own legal permissions remain separate.

What do insurance and the guarantee actually protect?

They address specified recruitment-service risks and remedies, rather than promising compensation for every difficulty in a job. Employers should receive the insurance document and check which event is covered from which date.

The regulation requires insurance for each service contract, covering the employer’s recruitment service amount, or part of it, in the specified cases and the worker’s return ticket. Some cover begins on arrival or transfer; cover relating to refusal to work without an acceptable excuse or departure without a lawful reason begins after 90 days.

Reports of the ministry’s explanation distinguish a full refund in qualifying circumstances during the first 90 days from a partial refund for domestic workers after that initial period and up to two years. The applicable category and event must be established before treating either period as an unconditional entitlement.

The regulation also permits an agreed replacement instead of a refund in specified cases. That is a contractual remedy between the employer and office, not permission to ignore a worker’s wages, documents, health or consent.

What is a recruitment service contract? It is the written agreement under which a licensed office recruits a worker, or transfers a worker’s services, for an employer. It is distinct from the employment terms governing the worker’s job and from permission to work in Oman.

Can an employer lose the right to a refund?

Yes. The framework attaches conditions to employer remedies and does not protect an employer’s own misconduct. The published text identifies circumstances in which the refund right falls away.

These include misrepresentation of working conditions, non-payment of wages beyond the specified periods, and harassment or violence against the worker. The wage provision refers to more than two consecutive months or three non-consecutive months within a year.

That threshold is a condition of the recruitment refund mechanism, not a lawful grace period for withholding wages. A worker should not be told to accept unpaid salary simply because an employer’s separate guarantee has not yet been forfeited.

Employers also need to notify the office within the applicable period and retain evidence of the event relied upon. The existence of insurance does not remove the need to show that the case falls within the policy and regulation.

What protections concern the worker directly?

The office must provide clear job information, respect the worker’s documents and comply with restrictions on charges. The regulation requires a written offer setting out the work, conditions and wages before arrival.

It prohibits recruitment offices from collecting amounts or fees from workers for recruitment or employment, and from retaining passports or official documents without written consent. It also sets responsibilities concerning medical checks, records, accommodation and information about rights and complaint channels.

The prohibition on recruitment fees should not be converted into an inaccurate statement that no recovery is possible in any legal dispute. A separate provision addresses limited recovery of costs in specified circumstances, including departure without lawful reason or substantiated misconduct. Its application requires the actual facts and legal conditions.

Workers should keep the offer, employment contract, receipts, permit documents and messages concerning pay and duties. Where the work offered changes, compare the written terms rather than relying only on a verbal assurance from a middleman.

What must Indian recruits verify separately?

They must verify the Indian recruitment process as well as the Omani employer, occupation and permission. An Omani office’s licence does not replace registration or emigration requirements on the Indian side.

The Embassy of India in Muscat’s recruitment guidance states that foreign employers recruiting nurses from India in ECR countries need a Country Specific Order and eMigrate registration, whether recruitment is through a government or private agency. That occupation-specific instruction should not be assumed to describe every job identically.

The embassy links the official registered-agent list and identifies the relevant document checklist. Applicants should use those official checks to establish who is arranging the recruitment and what the approved offer says. A forwarded logo, a mobile number or a claim that an agency “works with the embassy” is not the same as registration.

The wider Visa section and Business section provide related reporting. The new office regulation is not a visa amnesty, an exemption from Omanisation restrictions or approval to work in any occupation chosen by an intermediary.

Where can a complaint go?

The complaint route depends on whether the issue concerns the recruitment office, the employer or assistance needed by an Indian national. Keep those responsibilities separate so the complaint reaches the right authority.

Oman’s government portal lists a complaint service against recruitment offices, alongside separate employer, contract and work-permit services. A recruitment dispute is not necessarily resolved by a visa enquiry.

The Indian Embassy’s labour-complaints page provides a consular route for Indian nationals seeking assistance. Consular help does not replace a decision by the Omani authority, but can help a worker identify the appropriate process and supporting records.

Describe the issue precisely: the agreed job, money paid, document retained, wages outstanding, relevant dates and the party responsible. Do not hand over original documents to an unverified person claiming that a payment is needed to release a refund.

What happens next, and how should this guide be used?

Recruitment offices, employers and overseas partners need to align their licences, offers, contracts and insurance arrangements before 1 January 2027. Further ministry explanations may clarify practical implementation, but they should be read against the regulation rather than treated as a replacement for it.

This explanation was checked on 5 November 2026. Use the Ministry of Labour’s current instructions, the published decision and the Indian Embassy’s applicable recruitment guidance before signing or travelling. Seek a case-specific assessment where the contract, a recovery demand or a worker’s permission is disputed.
